Petycja do władz Wrocławia w obronie zabytkowego Stadionu Olimpijskiego [PL, DE, ENG]

Szanowny Panie Prezydencie! Szanowni Radni i Radne Wrocławia!

W trosce o dobro mieszkańców oraz dziedzictwo historyczne naszego miasta apelujemy do Państwa o:

1. niezwłoczne wszczęcie procedury unieważnienia miejscowego planu zagospodarowania przestrzennego nr 460 przyjętego Uchwałą Rady Miejskiej Wrocławia nr XLVI/1106/13 w dniu 27 czerwca 2013 r., zmieniającą Uchwałę L/3130/06 Rady Miejskiej Wrocławia z dnia 19 kwietnia 2006 r. w sprawie uchwalenia miejscowego planu zagospodarowania przestrzennego obszaru w rejonie Stadionu Olimpijskiego we Wrocławiu z uwagi na niezgodność z wpisem do rejestru zabytków nr A/4225/457/Wm;
2. doprowadzenie wszelkimi możliwymi środkami do natychmiastowego wstrzymania budowy budynku zamieszkania czasowego na terenie zabytkowego zespołu basenów olimpijskich zlokalizowanych na działce nr 1/8, AR 9, obręb Zalesie, we Wrocławiu, chronionych na mocy Ustawy o ochronie i opiece nad zabytkami;
3. objęcie szczególną ochroną największych w mieście publicznych, otwartych, zielonych terenów, jakim jest obszar Stadionu Olimpijskiego, idealnie predysponowany do uprawianiu sportów.

Sprzeciwiamy się trwającej degradacji bezcennego, zabytkowego kompleksu Stadionu Olimpijskiego. Na naszych oczach niszczony jest światowej klasy zabytek, parcelowany na działki deweloperskie największy otwarty teren w mieście.

Zawiodły wszystkie instytucje powołane do ochrony zabytków, w szczególności Miejski Konserwator Zabytków, zawiedli politycy uchwalając jednogłośnie wadliwy, miejscowy plan zagospodarowania przestrzennego, który pozwala na obecną inwestycję. Zawiódł również gospodarz Stadionu Olimpijskiego - Akademia Wychowania Fizycznego we Wrocławiu, która uzyskała ten teren od Skarbu Państwa w celu krzewienia kultury fizycznej. Tylko dzięki interwencji mieszkańców w 2015 roku zaniechano budowy apartamentowca na terenie basenów olimpijskich. Przez 6 kolejnych lat nie zrobiono niczego, aby faktycznie uratować Stadion. Teraz deweloper buduje to samo, tylko pod zmienioną nazwą. 

Panie Prezydencie, Panie i Panowie Radni. Niestety, na Państwa barki spada trud naprawy złych decyzji podjętych za czasów poprzednich władz samorządowych. Miejscowy plan zagospodarowania przestrzennego z 2013 roku nie powinien był być sporządzony i uchwalony w aktualnie obowiązującym kształcie. Tego planu nie powinni uzgodnić konserwatorzy zabytków: miejski i wojewódzki, nie powinien zaakceptować Wojewoda Dolnośląski. Ten plan posiada podstawową wadę – jest sprzeczny z literą i duchem Ustawy o Ochronie Zabytków i Opiece nad Zabytkami. Plan przewiduje zniszczenie istniejących budowli, rozparcelowanie i zabudowę mieszkaniową, prowadzące bezpowrotnie do definitywnego zrujnowania kompleksu i utraty jego funkcji. W karcie ewidencyjnej kompleksu Stadionu Olimpijskiego, wpisanego do rejestru zabytków pod numerem A/4225/457/Wm pkt. 19 zapisano wprost:

[p. 19] “Istniejące zagrożenia, najważniejsze postulaty: - zachowanie układu przestrzennego zespołu; - zabezpieczenie i odbudowa kompleksu basenu.”

Wydane pozwolenie na budowę, czyli legitymizacja prowadzonej obecnie destrukcji basenów, opiera się o plan, który jest wadliwy. Wobec tego plan ten należy jak najszybciej wycofać z obrotu prawnego.

Teraz na Prezydencie i Radzie Miasta spoczywa ciężar uratowania Stadionu Olimpijskiego za wszelką cenę, wszelkimi sposobami i bezzwłoczne. Jeśli nie władze Wrocławia, to kto? Nie liczmy na nic dobrego ze strony gospodarza Stadionu – AWF, która niewłaściwie zarządza darowanym od Skarbu Państwa bezcennym, publicznym terenem. Władze miasta mają narzędzia i możliwości uratować Stadion. Gmina Wrocław jest współwłaścicielem kompleksu, m.in. dróg dojazdowych. Tylko natychmiastowe wstrzymanie trwającej budowy oraz unieważnienie obowiązującego planu miejscowego uchroni Stadion Olimpijski przed ostatecznym zniszczeniem. Jeśli apartamentowiec stanie na miejscu basenów olimpijskich, bezpowrotnie zrujnowany zostanie cały kompleks. Ten zabytkowy, harmonijnie zaprojektowany zespół służył uprawianiu sportu przez ponad 90 lat. Wrocławianie bardzo potrzebują takich terenów. Nie straćmy ich!

Kompleks Stadionu Olimpijskiego jest zabytkiem klasy światowej – projekt Richarda Konwiarza (który pracował m.in. przy wystawie WuWA) otrzymał medal na Igrzyskach Olimpijskich w Los Angeles w 1932 r. Oprócz istniejących kortów tenisowych, stadionu lekkoatletycznego, strzelnicy, Pól Marsowych, zespołu basenów, oferował przeznaczenie terenów do uprawiania także innych dyscyplin sportu, w tym: tor wrotkarski, boisko do rugby, boisko do koszykówki, zaplecze i trybunę do oglądania rywalizacji załóg wioślarskich na przyległym kanale Odry, tor regatowy tamże, boisko do hokeja na trawie, otwartą arenę zapaśniczą, łąkę do gier, etc. Na świecie takie perełki się restauruje, przywraca do życia, gospodarze i mieszkańcy są z nich dumni. Też tego chcemy!

Sehr geehrter Herr Präsident der Stadt Wrocław, sehr geehrte Stadträtinnen und Stadträte von Wrocław! Besorgt über das Wohlergehen der Bewohner von Wrocław und das historische Erbe unserer Stadt fordern wir Sie auf:

1. Das Verfahren zur Aufhebung der örtlichen Raumordnung Nr. 460, die durch den Beschluss des Stadtrats von Wrocław Nr. XLVI/1106/13 am 27. Juni 2013 genehmigt wurde, der den Beschluss des Stadtrats Nr. L/3130/06 vom 19. April 2006 über die Genehmigung der örtlichen Raumordnung (mpzp) im Bereich von Olympiastadion in Wrocław abändert, wegen Nichtbeachtung der Eintragung in das Register der Denkmäler Nr. A/4225/457/Wm unverzüglich einzuleiten;
2. Mit allen möglichen Mittel einen sofortigen Stopp des Baus des Gebäudes zum vorübergehenden Wohnaufenthalt im historischen Ensemble der Olympischen Sportschwimmbecken auf dem Flurstück Nr. 1/8, AR 9, Gemarkung Zalesie in Wrocław, das nach dem Gesetz zum Schutz und zur Pflege von Denkmälern geschützt wird, zu bewirken;
3. Die größten öffentlichen offenen Grünflächen, die das Gebiet des Olympiastadions darstellt, und zum Sport treiben perfekt prädisponiert ist, besonders zu schützen.

 Wir sind gegen den laufenden Abbau des wertvollen historischen Komplexes des Olympiastadions. Vor unseren Augen wird ein Weltklasse-Denkmal, die größte offene Fläche in der Stadt, in Bauparzellen für diverse Bauherren geteilt.

Alle Institutionen zum Schutz von Denkmälern, insbesondere der städtische Denkmalkonservator, sowie Politiker, die einstimmig die Genehmigung der fehlerhaften örtlichen Raumordnung beschlossen haben, welche die aktuelle Investition ermöglicht, scheiterten. Es scheiterte auch der Besitzer des Olympiastadions - Universität für Körperkultur in Wrocław, der das Grundstück von der Staatskasse bekommen hat, um Körperkultur zu fördern. Nur durch eine Intervention der Stadteinwohner wurde 2015 auf den Bau eines Wohnungsgebäude auf dem Grundstück der Olympia-Schwimmbecken verzichtet. Während sechs aufeinander folgender Jahre wurde nichts getan, um das Olympia-Stadion zu retten. Jetzt plant der Bauherr das gleiche Bauvorhaben, nur unter einem anderen Namen. 

Herr Präsident der Stadt Wrocław, Stadträtinnen und Stadträte!

Leider liegt die Verantwortung für die fehlerhaften Entscheidungen, die während der Amtszeit des vorherigen Stadtrats getroffenen wurden, auf ihren Schultern. Die örtliche Raumordnung von 2013 durfte in der aktuellen Form nicht erstellt noch verabschiedet werden. Dieser Plan sollte weder vom Stadt- noch Woiwodschaftskonservator genehmigt werden, und der Woiwode von Niederschlesien durfte den Plan nicht akzeptieren. Dieser Radunordnung hat einen grundlegenden Fehler - sie steht im Widerspruch zu Geist und Buchstaben des Gesetzes über den Schutz der Denkmäler und der Denkmalpflege. Der Plan sieht vor, die bestehenden Bauten zu zerstören, zu parzellieren und für Wohnzwecke zu bestimmen, was den Komplex unwiderruflich ruinieren, und zum endgültigen Verlust seiner Funktion führen wird. In der Registrierungskarte des Olympiastadions wurde im Register der Denkmäler unter der Nummer A/225/457/Wm im Punkt 19 eingetragen:

[Pkt. 19] „Bestehende Bedrohungen, die wichtigsten Forderungen: - Beibehaltung der räumlichen Anordnung des Ensembles; - Schutz und die Wiederherstellung des Sportschwimmbeckens-Komplexes".

Der Bescheid über die Baugenehmigung, also die Legitimität der gegenwärtigen Zerstörung von Sportschwimmbecken, beruht auf einem Plan, der fehlerhaft ist. Daher ist dieser Plan so schnell wie möglich dem Rechtsverkehr zu entziehen.

Nun obliegt dem Präsident der Stadt Wrocław und dem Stadtrat die Last das Olympiastadion um jeden Preis, mit allen Mitteln und ohne Verzögerung zu retten. Und wenn die Behörden von Wrocław dies nicht tun, wer dann? Wir erwarten nichts Gutes seitens des Besitzers des Olympiastadions  - der Universität für Körperkultur Wrocław, der das ihr durch die Staatskasse geschenkte öffentliche Grundstück von unschätzbarem Wert nicht ordnungsgemäß verwaltet. Die städtischen Behörden haben die Werkzeuge und Möglichkeiten das Olympiastadion noch zu retten. Die Gemeinde Wrocław ist Miteigentümer des ganzen Komplexes, einschließlich Zufahrtsstraßen. Nur die sofortige Einstellung des begonnen Bauvorhabens und die Nichtigerklärung der geltenden Raumordnung wird das Olympiastadion vor der endgültigen Zerstörung schützen. Wird ein Wohnhochhaus dem Gelände der olympischen Sportschwimmbecken gebaut, so wird der gesamten Komplex unwiederbringlich zerstört werden. Dieses historische, harmonisch gestaltete Bauensemble diente seit über 90 Jahren zum Sport treiben. Die Einwohner von Wrocław brauchen solche Sportbereiche sehr. Lassen wir sie uns nicht nehmen!

Der Olympiastadion-Komplex ist ein Denkmal von Weltrang - Der Entwurf von Richard Konwiarz (der auch u.a. an der WuWA-Architekturausstellung gearbeitet hat) erhielt im Jahr 1932 eine Medaille auf den Olympischen Spielen in Los Angeles. Neben bestehenden Tennisplätzen, Leichtathletikstadion, Schießstand, Champs de Mars, Sportschwimmbecken-Komplexes, umfasste sein Projekt auch Zweckbereiche für andere Sportarten, einschließlich Rollschuhbahn, Rugby-Spielplatz, Basketballplatz, Sozialräume und Tribünen für Fans der Ruderwettbewerbe auf dem benachbarten Oder-Kanal, Regattabahn, Feldhockey-Spielplatz, Wrestling-Arena , Spielwiese, usw. In der ganzen Welt werden solche Perlen restauriert, belebt, die ihre Verwalter und die Einheimischen sind stolz auf sie. Das ist es, was wir wollen!

Dear Mayor of Wrocław! Dear Members of Wrocław City Council!

In an attempt to secure public interest and the well-being of cultural heritage of Wrocław we hereby plea that you:

• immediately overrule the local spatial plan no. 460 approved by Wrocław City Council resolution no. XLVI/1106/13 of 27 June 2013 that amended Wrocław City Council resolution L/3130/06 of 19 April 2006 concerning the preparation of the local spatial plan for the area of the Olympic Stadium in Wrocław because it is in violation with the register of listed, historic monuments no. A/4225/457/Wm;
• use all available means to immediately halt the construction of the apartment building at the site of the historic outdoor swimming pool complex in plot 1/8, AR 9, Zalesie district, Wrocław, which is a part of a listed conservation area protected under The Act on the Protection of Monuments and the Preservation of Monuments;
• use your powers to protect the Olympic Complex, which is the largest, public, outdoor recreation area and which has the capacity to foster sports and leisure activities;

We oppose the progressing degradation of the priceless Olympic Complex. What we are seeing at the moment is the destruction of a world-class historic monument whose outdoor, public area and sites are being carved into development land.

So far we have witnessed the fiasco of all institutions and public persons obliged to protect our cultural heritage and to act in defense of the Complex. We have seen shameful inaction of the Municipal Conservation Office. We have seen the failure of local councillors as they unanimously supported the local spatial plan that paved the way for the current residential development. We have also seen the failure of the authorities of the University School of Physical Education in Wrocław, which obtained the Olympic complex from the State in order to foster physical education. We owe it to the public vigilance that in 2015 plans to build a large apartment building at the site of the outdoor swimming pool complex failed to secure approval. This was followed by 6 years of inaction. In that period nothing was done to prevent the site from further deterioration. Now, Dolnośląskie Inwestycje Sp. Z o.o, a development company, has been allowed to build the same type of building under a different name.

Dear Mayor, Dear City Councillors it is your duty to rectify the consequences of shameful decisions taken by your predecessors. The local spatial plan of 2013 should not have been approved in its current shape and form. It should not have been approved by the Municipal Conservation Office, the Regional Conservation Office nor the Office of the Lower Silesian Voivodeship. The plan has an inherent flaw, namely it is in breach of The Act on the Protection of Monuments and the Preservation of Monuments. The current spatial plan allows for the destruction of the surviving buildings, defragmentation of the Olympic Complex, and residential development. All those will irreversibly result in the decomposition of the Complex and ruin its statutory function. The record for the Olympic Complex listed as a conservation site A/4225/457/Wm stipulates in point 19 as follows:

“Risks, mitigating risks: preserving the spatial integrity of the Complex; protecting and restoring the outdoor swimming pool complex.”

The building permit granted to the developer legitimizes the destruction of the remains of the outdoor swimming pool complex. However, let's not forget, the local spatial plan for the Olympic Complex the building permit was based on is in itself flawed. It is therefore necessary to nullify this spatial plan.

It is up to the Mayor of Wrocław and Wrocław City Council to save the Olympic Complex at any cost, by all possible means, and as quickly as possible. Who else has the capacity to salvage the historic site if not the local authorities? One thing is certain, we cannot hope to count on the University School of Physical Education in Wrocław, the custodian of the Complex, which has been proved beyond any doubt to have been mismanaging public grounds handed into its custody by the State. The Municipality has the legal means to prevent misconduct and it is also the co-owner of the Olympic Complex, which includes its ownership of some of the access roads within the Complex. The only way at this stage to prevent the Olympic Complex from suffering irreparable damage to its integrity is to halt the construction works and nullify the existing spatial plan for the Complex. Should the planned apartment building be erected at the site of the outdoor swimming pool complex, the entire design of the Olympic grounds will be ruined. This historic Complex, so well designed, has served its purpose of fostering sporting activities for almost 90 years. The citizens of Wrocaław desperately need such places. Let's not squander them!

The Olympic Complex is a world-class heritage site. The design by Richard Konwiarz, who also collaborated on the WuWA project (among others in Wrocław), was awarded the gold medal at the Los Angeles Olympics in 1932. Apart from the surviving facilities that include tennis courts, an athletic stadium, a shooting range, the Field of Mars, a swimming pool complex, the Olympic Complex has had additional facilities such as roller skating track, a rugby pitch, a basketball field, bleachers and supporting facilities for a natural rowing track, a sailing facility, a field hockey pitch, an outdoor wrestling arena and multipurpose open grounds. Elsewhere in the world sites like this are subject to meticulous reconstruction so that both local authorities and citizens can be proud of them. It is exactly how we wish to feel about this place.
